3. Products and Ordering

3.1 All products displayed on our website are subject to availability. We reserve the right to discontinue any product at any time without prior notice.

3.2 We take reasonable care to ensure that product descriptions, images, and prices on our website are accurate. However, we do not warrant that product descriptions, images, or other content on this website are error-free.

3.3 An order confirmation email does not constitute acceptance of your order. A contract between you and Earthcove, Inc. is formed only when your order has been dispatched and you receive a shipping confirmation email.

3.4 We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

3.5 In the event of a pricing error, we will notify you and give you the option to proceed at the correct price or cancel your order for a full refund.

4. Pricing and Payment

4.1 All prices are displayed in US Dollars (USD).

4.2 Sales tax will be calculated and applied at checkout where applicable, based on the delivery address and in accordance with the tax laws of the relevant state.

4.3 We accept payment via Stripe, PayPal, Revolut, Klarna, Google Pay, and Apple Pay. All payments are processed securely through our third-party payment providers.

4.4 Payment must be received in full before your order is dispatched.

5. Shipping and Delivery

5.1 We currently ship to addresses within the United States. For international orders, please visit our UK website at earthcoveswim.com.

5.2 Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by shipping carriers, customs, weather, or other events beyond our reasonable control.

5.3 Risk of loss and title to products passes to you upon delivery of the products to the carrier.

5.4 If your order arrives damaged or is missing items, please contact us within 7 days of receipt at hello@earthcoveswim.com.

6. Product Safety

6.1 Our products are designed and tested in accordance with applicable US consumer product safety regulations, including those administered by the Consumer Product Safety Commission (CPSC) where applicable.

6.2 Our products are GOTS (Global Organic Textile Standard) certified and are free from PFAS, phthalates, formaldehyde, and BPA. Our swimwear is made from GOTS certified organic cotton with 2% elastane for stretch and fit.

6.3 Please always follow the care instructions and safety guidance provided with each product.

7. Returns and Refunds

7.1 We want you to be completely happy with your purchase. If for any reason you are not satisfied, you may return unused, unworn products in their original packaging within 30 days of delivery for a full refund of the product price. This applies to all items, including sale and discounted products.

7.2 To initiate a return, please contact us at hello@earthcoveswim.com with your order number and reason for return.

7.3 Return shipping costs are the responsibility of the customer, unless the product is faulty or we have sent you an incorrect item.

7.4 Refunds will be processed to the original payment method within 14 business days of receiving the returned product.

7.5 Swimwear may only be returned if the hygiene seal/liner is intact and the product is unworn. This is for hygiene reasons and applies to all swimwear products.

8. Faulty Products

8.1 If a product is defective or not as described, please contact us within a reasonable time of discovering the fault at hello@earthcoveswim.com.

8.2 We will, at our discretion, offer a replacement, repair, or full refund (including return shipping costs) for any product that is confirmed to be faulty.

8.3 We may request photographic evidence of the fault before processing a return or refund.

9. Sales and Discount Codes

9.1 Discount codes cannot be used alongside sale items or other discount codes.

9.2 We reserve the right to cancel any orders which redeem a discount code on already discounted items.

10. Intellectual Property

10.1 All content on this website, including but not limited to text, images, logos, designs, graphics, and software, is the property of Earthcove, Inc. or Earthcove Ltd and is protected by United States and international copyright, trademark, and other intellectual property laws.
